Terms of Service

This is the agreement between Amvela and your salon. It is written to be read, not to be skimmed past — if any of it is unclear, ask before you agree to it rather than after.

1Who you are contracting with

Amvela is operated by Catalina Andreea Ciofaca, a sole trader trading as Amvela, of 111 Upton Park Road, London, E7 8LA, United Kingdom.

In these terms, “we” and “Amvela” mean that business. “You” means the salon that holds the account. “Your clients” means the people your salon books in — they are not our customers and we have no relationship with them.

2What Amvela is

Amvela is software you use over the internet to run a salon: a diary, online booking, client records, a till, staff rotas and payroll figures. We host it and maintain it. You do not install anything and you do not own a copy of it.

Your salon gets its own separate database. Your records are not mixed into a shared table with other salons’. That is a deliberate design decision and it is how we keep one salon from ever seeing another’s.

3Your account

You are responsible for everyone you give access to, and for what they do with it. Give each person their own login — shared logins make it impossible to tell who did what, and the audit trail is one of the things you are paying for.

We cannot see or set your password, and neither can anyone working for us. Passwords are stored only as a one-way hash. If you lose access, we can issue a one-time reset link to a member of your staff; we cannot choose a password on your behalf. This is deliberate: an administrator who can set your password can read your takings.

You must tell us promptly if you believe an account has been compromised.

4Your data stays yours

Everything you put into Amvela — your clients, appointments, sales figures, staff records — remains yours. We do not sell it, we do not share it with other salons, and we do not use it to train anything.

We access your salon’s data only when you ask us to (for support), when we have to in order to keep the service running or secure, or where the law requires it. Where we do, it is recorded in your salon’s audit log.

How we handle personal data, and the respective responsibilities of you and us under UK GDPR, are set out in the Privacy Policy, which forms part of these terms.

5What you must not do

  • Upload anything unlawful, or anything you have no right to hold.
  • Use Amvela to send marketing to people who have not agreed to receive it. Amvela records consent per channel; that record only helps you if you use it honestly.
  • Attempt to reach another salon’s data, probe the service for weaknesses without asking us first, or work around access controls.
  • Resell or rebrand Amvela as your own product without a written agreement.
  • Put load on the service that is obviously beyond running a salon — automated scraping, bulk requests, load testing.

6What you pay

  • Subscription — £30 per salon, per month. Billed monthly in advance.
  • Booking commission — 0.5% of the value of each appointment booked through Amvela’s online booking. See below.
  • VAT — Amvela is not currently registered for VAT, so no VAT is added. If that changes we will tell you before it affects an invoice.

How the booking commission works

When a client books an appointment through your public booking page, we record a commission of 0.5% of the booking’s value. It is added as a line on your next monthly invoice. It is not taken from the client and it is not deducted from any deposit.

Two things worth being plain about:

  • The rate is fixed at the moment the booking is made. If we ever change the rate, bookings already taken keep the rate they were booked at.
  • If an appointment is cancelled or does not go ahead, the commission on it is voided and you are not charged for it.

Commission applies only to bookings made through Amvela’s online booking. Appointments your staff enter into the diary themselves carry no commission.

Payment

Payments are handled by Stripe. We never see or store your card number. Stripe’s terms apply to the payment itself.

7The trial

New salons get 14 days free and we do not ask for a card to start one. If you do nothing at the end of it, the account simply stops — you are not enrolled into a paid subscription by default and there is nothing to cancel.

8If payment stops

We would rather you kept your books than lose them over a failed card. So access degrades in steps rather than switching off:

  • Read-only. When a subscription lapses, you can still open Amvela and read everything — today’s diary, client records, past takings — but you cannot record anything new.
  • Blocked. Only if an account is archived does the app stop opening at all.

Your data is not deleted at either step. See section 11 for what happens if you leave for good.

9Availability and support

We will keep Amvela running and reasonably up to date, and we take backups daily. We do not offer a guaranteed uptime figure, and we are not going to pretend otherwise: Amvela is a small operation running on a single well-kept server, and an honest description is worth more to you than a number we cannot stand behind.

Support is by email, from a person who knows the product. We aim to answer within one working day.

We may occasionally take the service down for maintenance. Where we can plan it, we will tell you first and do it outside salon hours.

10Changes

We will keep improving Amvela, and features may change. We will not remove something you rely on without warning you.

If we change these terms or the price in a way that materially affects you, we will give you at least 30 days’ notice by email. If you do not want to continue on the new terms, you can end the agreement before they take effect and we will refund any period you have paid for but not used.

11Ending the agreement

You can stop at any time. Cancel before your next billing date and you will not be charged again; the subscription runs to the end of the period you have already paid for. We do not refund part-months, except in the case described in section 10.

Before you go, export your data. Ask us and we will provide your salon’s records in a standard, readable format, free of charge.

We keep your data for 90 days after an account ends, so that a salon that changes its mind — or realises it needed last year’s figures — is not stuck. After that it is deleted permanently, including from backups as they age out. If you want it deleted sooner, ask and we will do it.

We may end the agreement if you seriously or repeatedly break these terms, or if payment is more than 60 days overdue. We will tell you first and give you a chance to put it right, unless the breach makes that unreasonable.

12Liability

Amvela is a tool for running your salon. It does not make your business decisions and it does not replace your own records where the law requires you to keep them — your tax records and your employment records remain your responsibility.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability to you in any twelve-month period is limited to the amount you paid us in that period. We are not liable for lost profits, lost business or lost goodwill.

You are contracting as a business, not a consumer, so the consumer rights rules do not apply to this agreement.

13Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If any part of these terms turns out to be unenforceable, the rest of them still stand.
